Terms of Sale: Public Training

These terms apply when you buy a place in a Digital Attitudes public workshop, program or holiday intensive through this website. Read them before you pay — the cancellation windows are short, and they are the part people are most often surprised by.

This set of terms was written in-house by Digital Attitudes. It has not been reviewed by a qualified Australian legal practitioner, and it must be before the business relies on it.

It is published in this state on purpose. An inaccurate policy is worse than an unreviewed one, and until now this site either said nothing about how it works or described things it does not do. What follows is an honest description of how Digital Attitudes actually operates today. Treat it as that, not as legal advice — ours or yours.

Your rights under the Australian Consumer Law

Nothing on this page takes away rights you have under the Australian Consumer Law. Our services come with consumer guarantees that cannot be excluded. If a service is not delivered with due care and skill, or is not fit for the purpose we said it was for, you are entitled to a remedy — and where the failure is major, that includes cancelling and getting a refund, whatever the cancellation windows below say.

The refund and credit rules on this page are what we offer in addition, for the ordinary case where you simply change your mind or your circumstances change. They are not a limit on your statutory rights, and if the two ever conflict, the law wins.

Who we are

Digital Attitudes (ABN 88 989 534 755) is an Australian consultancy and training provider based in Melbourne, Victoria, working nationally.

Digital Attitudes currently trades as a sole trader and is in the process of incorporating. Once that happens the contracting entity, its ACN and its registered address change, and these pages must be updated before any further sales are taken: [TO CONFIRM: trading entity name, ACN and registered office address once incorporation completes; confirm the ABN above still belongs to the entity taking payment]

Who can attend

  • Public workshops are for adults aged 18 and over.
  • Student programs are for participants aged 15 and over, and a parent or guardian must provide consent. How we handle a student participant’s information is set out in our privacy policy.

If you book a place for someone who does not meet the age requirement, we will cancel the booking and refund it in full.

Prices and payment

Prices are in Australian dollars. Digital Attitudes is not currently registered for GST, so no GST is added to the prices shown. We intend to register for GST; when we do, the prices on this page will be updated and labelled accordingly.

Payment is taken upfront through Stripe before a place is confirmed. A place is not held, reserved or guaranteed until payment has succeeded — starting a checkout does not hold a seat. Card details are entered on Stripe’s own payment page and never reach us.

The price you pay is the price shown at the time of purchase. If we change a price later, that does not change what you already paid, and it does not entitle you to a refund of the difference.

If you cancel or change your mind

Two sets of rules apply, depending on what you booked. Both are measured against the scheduled start of the first session.

Transfers. A standard public ticket can be transferred to another person, provided they meet the age requirement and you give us reasonable notice so we can update the list. Tell us who is coming instead, at hello@digitalattitudes.com.au.

School holiday programs

Holiday programs run once, in a small group, and are planned and staffed well in advance. The windows are correspondingly longer.

A holiday program place is not transferable to another student. The group is built around the students in it, so we cannot swap someone in.

Credits

A credit is issued for the amount you actually paid, not the list price. It is valid for 12 months from the date it is issued, can be put towards another Digital Attitudes program, and is not refundable for cash. If it is not used within 12 months it lapses.

Not turning up

If you do not attend and have not cancelled, there is no refund and no credit. This applies whether or not you tell us afterwards.

If we cancel or change a program

We may have to cancel, reschedule or change the format of a session — because too few people booked, because a facilitator is unwell, or because of something outside our control.

  • If we cancel a program, we will offer you a transfer to another date or a rescheduled session first. If neither suits you, you get a full refund.
  • If a single session inside a multi-session program is disrupted, we will reschedule that session or issue a credit for it. We will not treat the whole program as delivered when part of it was not.
  • If we change the format — for example moving an in-person session online — we will tell you before it happens, and if the change does not work for you, you can cancel that session for a refund.

We will always tell you as early as we reasonably can, using the contact details on the booking.

How refunds are paid

An approved refund is returned to the original Stripe payment method — we cannot send it to a different card or account. We process approved refunds within 5 business days.

After that, how long the money takes to appear is up to your bank or card issuer, and it is out of our hands. Several business days beyond our processing time is normal.

What you need to bring

You need to bring your own laptop to any hands-on session. Please read this part before you book rather than on the morning.

  • A tablet or iPad is not sufficient for the technical sessions, including the app-building programs. You need a laptop running Windows, macOS or Linux, with a keyboard, a browser and the ability to install or sign in to the tools the session uses.
  • We do not promise a loan device. We may occasionally have a spare, but you should not book on the assumption that one will be available, and we will not hold one for you.
  • Arriving with an unsuitable, locked-down or broken device is not grounds for a refund or a credit. A heavily managed work or school laptop that will not let you install software or reach the sites a session needs counts as unsuitable.

If you are not sure whether your device or your workplace restrictions will be a problem, ask us at hello@digitalattitudes.com.au before you book. We would much rather answer that question than refuse a refund.

What you build, and how sessions run

App-building sessions are covered by our Project Content & Acceptable Use Policy, which explains what projects may and may not be about. Participants are expected to follow it and to treat other participants decently.

If someone has to be removed from a session for conduct or for repeatedly ignoring that policy after being asked to change course, no refund or credit is given. For a student participant, we will contact the parent or guardian, and the school if the program runs through one.

What we do and do not promise

We promise to deliver the session described, with due care and skill, by someone who knows the material. We do not promise a particular business result, a working finished product, a job, a grade, or that any third-party tool used in a session will keep working, keep its pricing, or remain available. Where a session depends on an external AI tool, its availability and behaviour are not ours to guarantee.

Except for the consumer guarantees described at the top of this page, and anything else the law does not allow us to exclude, our liability for a training booking is limited to re-supplying the session or refunding what you paid for it.

Privacy

What we collect when you book, and what we do with it, is set out in our privacy policy. Registration consent and marketing consent are separate — buying a place does not sign you up to anything else.

Governing law

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction — without limiting your right to use a consumer dispute body or the ACCC.

Changes to these terms

We may update these terms. The terms that apply to a booking are the ones published when you paid, and we keep a record of them against the booking so a later edit cannot change the deal you made.
